Hold The Beat Terms of Service

1. Purpose of the Service

Hold The Beat is a progressive web application (PWA) designed to help adult men improve their ejaculatory control and sexual stamina through:

• Visual and auditory trainer based on the Start-Stop method (Semans).
• Kegel muscle strengthening exercises and breathing techniques.
• Adaptive algorithm that personalizes difficulty based on your progress.

The service is exclusively intended for persons over 18 years of age.

2. Acceptance of Terms

By accessing, registering, or using Hold The Beat (the website www.holdthebeat.com and all its functionalities), you declare that you have read, understood, and accepted:

• These Terms of Service.
• The linked Privacy Policy.

If you do not agree with these terms or are not 18 years of age, you must not use the service.

3. Non-Medical Nature of the Service

Hold The Beat is NOT a medical service. The exercises and training are based on techniques widely documented in scientific literature on sexuality, but are offered solely as:

• Self-training guide.
• Educational tool for muscle control.

Important warnings:

• It does not replace consultation with doctors, urologists, clinical psychologists, or sexologists.
• If you experience pain, persistent dysfunctions, sexual health problems, or any medical doubt, consult a healthcare professional immediately.
• Results vary from person to person. We do not guarantee specific improvements or concrete timelines.
• Suspend use if you feel physical or emotional discomfort.
• Use of the service is at your sole responsibility.

4. License to Use

We grant you a personal, limited, non-exclusive, revocable, and non-transferable license to access and use Hold The Beat exclusively for your personal and non-commercial training.

It is prohibited to:

• Share, resell, or transfer your access to third parties.
• Perform reverse engineering, decompilation, or attempt to access the source code.
• Use the service for illegal, fraudulent purposes or that infringe these terms.
• Extract data massively (scraping) or interfere with normal operation.

5. User Account and Security

In functionalities requiring registration (Pro version and advanced features):

• You are solely responsible for maintaining the confidentiality of your username and password.
• All activity under your account will be attributed to you.
• Immediately notify any unauthorized access through support@holdthebeat.com.

We may suspend or cancel accounts for:

• Serious or repeated breach of these terms.
• Fraudulent activity or that compromises the security of the service.
• Legal request from competent authorities.

6. Privacy and Data Processing (Specific Summary)

Hold The Beat is designed to maximize your privacy. The data model is extremely minimalist:

Data we do NOT collect:

• Full name
• Postal address
• Phone number
• Email (only for Pro registration)
• Complete bank details
• Persistent IP (only temporary security logs)

Data we DO collect:

• Username (pseudonym, not real)
• Password (bcrypt/argon2 hash)
• Session metrics (duration, BPM, stops, Kegel tests)
• Payment transaction ID (Stripe/PayPal/crypto)
• Temporary Session ID (UUID for anonymous tracking)
• Approximate age (range, optional)

Specific purposes of processing:

• Service provision: Record your sessions, progress, personal statistics, and adaptive recommendations, stored securely while your account is active.
• Payment management: Secure processing through Stripe (maximum 5 years by fiscal regulations).
• Algorithm improvement: Sending anonymized metrics to Google computing services (Gemini/Vertex AI) under the Data Privacy Framework to calibrate and optimize the service.

Irreversible anonymization:

When you delete your account or request cancellation:

• Your user table is COMPLETELY DELETED
• Session data remains with: session_id → NULL (deleted), anonymous_id → completely new UUID, user_id → NULL
• Result → Data impossible to re-identify

This anonymized data is used exclusively for:

• Aggregated statistical analysis
• Algorithm optimization and calibration
• Internal efficacy research

They will never be linked to your identity outside your active account.

Legal basis:

• Explicit consent (GDPR art. 9) for health/sexual life and progress data.
• Contract execution (GDPR art. 6.1.b) for the provision and execution of the training service.
• Anonymized legitimate interest for service improvement.

7. Payments and Access Passes

Available access passes:

• Free Access: Basic initial features.
• 4-Week Pass (€9.95): One-time payment for 4 weeks of full Pro access.
• Complete Program 16 Weeks (€29.85): One-time payment including 4 free weeks.

Payment model features:

• Single, non-recurring payment per time block with NO automatic subscriptions or recurring fees.
• Secure payment processing managed by Stripe or PayPal.
• Discreet bank descriptor ('HTB WELLNESS' or 'HTB').
• We do NOT store card or bank account details.
• Time Pass Stacking: Purchasing an additional time block extends your active access period cumulatively from your current expiration date (access_expires_at).

Right of withdrawal and refunds:

• Hold The Beat does NOT charge recurring subscriptions or auto-renewals.
• Right of Withdrawal: In accordance with EU digital content law, by purchasing and immediately accessing the service you consent to immediate performance and acknowledge the loss of your withdrawal right once service execution begins.
• If you have not accessed or used the service, you have 14 days from purchase to request cancellation and a refund by emailing support{'@'}holdthebeat.com with your transaction ID.

8. Intellectual Property

All content of Hold The Beat (algorithms, design, texts, audio, images) is intellectual property of Hold The Beat or its licensors. You only have the right to use it according to the license in point 4.

9. Acceptable Use

Prohibited to use Hold The Beat for:

• Accessing other people's accounts or interfering with other users.
• Introducing malware, spam, or illegal content.
• Massive scraping or automated use without permission.
• Any activity that violates applicable laws.

We reserve the right to suspend accounts for violations.

10. Limitation of Liability

Hold The Beat is offered "as is" without specific warranties:

• We do not guarantee concrete results (IELT improvement, exact time).
• We are not responsible for indirect damages, data loss, emotional problems, or effects on relationships.
• Maximum liability: amount paid in the last 12 months (or €100 if you have not paid).

This does not exclude liability for fraud, gross negligence, or personal damages according to law.

11. Interruptions and Maintenance

We may temporarily interrupt the service for maintenance or improvements. We will try to notify in advance, but we do not guarantee 24/7 availability.

12. Modifications of Terms and Service

We may modify:

• These Terms (we will publish an updated version).
• The service (add/remove features).

Substantial changes will be communicated with reasonable advance notice. Continued use implies acceptance.

13. Termination

You can:

• Stop using the service whenever you want.
• Request account deletion (elimination of identifying data).

We can:

• Suspend/close accounts for non-compliance.
• Cancel the service with prior notice.

14. Applicable Law

Spanish law. Courts of Madrid, unless European consumer regulations grant you other rights.
